Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Commissioner of Agriculture and Markets of the State of New York, which conditionally revoked petitioner’s milk dealer’s license and imposed a penalty of $2,500. Petitioner operates a dairy under a milk dealer’s license issued by respondent.
