This is a motion for judgment dismissing the complaint herein on the ground that it fails to state a cause of action. The action is one in equity for specific performance of a written agreement alleged to have been made by one Lydia Katz, deceased, in which she granted an option to the plaintiff to be exercised by him during the term of a certain lease of the premises No. 356 East One Hundred and Forty-fifth street, New York city, to purchase the said premises.
