Appeal from circuit court, New York county. Action by Nellie E. Earrell againt Albert Friedlander and Walter E. Cor-win. From a judgment for plaintiff, and from an order denying a motion for ■a new trial, defendants appeal.

The action was brought to recover damages for the alleged malicious prosecution by defendants of the plaintiff. In the year 1880, the defendants, as partners, were engaged in the manufacture of cloths, and the plaintiff was a designer in their employ. For some time prior to the alleged wrongful prosecution the defendants missed, upon various occasions, large quantities of silk and other articles, which, as the evidence showed, were, to some extent, subject to plaintiff’s control.
