Plaintiff Maine Yankee Atomic Power Company (“Maine Yankee ”) brought this suit to challenge the jurisdiction asserted by the State of Maine’s Board of Environmental Protection (“BEP” or “the Board”) and Department of Environmental Protection (“DEP” or “the Department”) over Maine Yankee’s planned transfer of spent nuclear power plant fuel from one on-site storage facility to another. The planned new storage system is referred to in the nuclear regulatory field as an “independent spent fuel storage installation” or “ISFSI”.…
