Plaintiff Milliken & Company (“Milliken”) filed this action against the defendants seeking to recover an $8,754,680 trade debt owed by defendant Duro Industries, Inc. (“Duro”). Milliken seeks to recover from defendant Duro Textiles, LLC (“New Duro”) as the corporate successor to Duro. This matter is before the court on the parties’ cross motions for summary judgment on Counts I and VII of the amended complaint.
