QUINN, Justice.

The defendant, Melvin Edward Billips, appeals from the district court’s denial of his motion for postconviction relief from his conviction and sentence of twenty-five to forty years for the crime of escape. He claims that the application to him of C.R.S. 1963, 40-8-210, which was enacted as part of the Colorado Criminal Code with an effective date of July 1, 1972, Colo.Sess.Laws 1972, eh. 46, 40-8-210, at 275-76, 1 violates the federal and state constitutional prohibitions against ex post facto laws.
