MEMORANDUM OPINION AND ORDER VACATING BANKRUPTCY COURT ORDER AND REMANDING TO BANKRUPTCY COURT

Debtor Richard B. Colvin (“Colvin”) appeals the bankruptcy court’s order dis*172missing with prejudice Colvin’s second adversary proceeding against Appellee Amegy Mortgage Company (“Amegy”). (Dkt. # 3.) For the foregoing reasons, the Court VACATES the bankruptcy court’s dismissal order and REMANDS to the bankruptcy court for proceedings consistent with this order.
