Berry, Justice:

This is an appeal by Chester Wilson, the defendant below and hereinafter referred to as defendant, from a final judgment of the Circuit Court of Wayne County entered February 17, 1972 wherein the court refused to set aside the jury verdict of guilty of voluntary manslaughter. The defendant was sentenced to one to five years in the West Virginia State Penitentiary but was granted a stay of execution pending the outcome of this appeal.
