Respondents Dean Cates, Randy Kucsan, Bill Tran, and Dana Way (the “Officers”) are police officers working for Montgomery County (the “County”). The County’s automated speed monitoring system captured the Officers exceeding the posted speed limits in police vehicles at various locations in the County. The initial citations were issued to the County, as the owner of the police vehicles. The County and the Montgomery County Police Department (the “Department”) determined that, although the Officers were on duty, they were not responding to emergencies, and the Department reissued the citations…
