This appeal is by defendant from a judgment in the sum of $5,211 entered upon the finding of the court in an action in the case.

The original declaration named as defendants the bank and its cashier, W. C. Kreft. Upon trial the court found both defendants guilty, whereupon plaintiff dismissed the cause as to Kreft and filed an amended declaration charging the bank alone. To this the defendant bank filed a plea of the general issue and a special plea setting up the statute of limitations. Plaintiff demurred to the special plea, and the court sustained the demurrer.
