This case comes here on appeal from the district court, sustaining a demurrer to plaintiff’s amended complaint. The amended complaint was filed July 14, 1943. The prayer of the amended complaint is as follows:

“Wherefore plaintiffs pray that the Court determine the constitutionality of House Bill No. 207, Chapter 149 of the 1943 Session Laws, and, if the Court finds it to be unconstitutional and void, that the Court make and enter its judgment restraining and prohibiting the said Board of Equalization from certifying to the County Auditors of the various Counties of the State of Idaho any ad…
