The action was brought to foreclose an assessment lien. It is stated in respondent’s brief:

“The respondent district is situated in the county of Yolo, state of California, and was organized as a reclamation district on the 29th day of May, 1908. On the 6th day of July, 1908, respondent levied an assessment of $132,000.00 over all the lands in the district. Shortly thereafter an action was brought by said respondent under section 3493% of the Political Code of this state to validate said assessment, and on the 5th day of October, 1908', a judgment was entered in the validation suit in…
