MEMORANDUM OPINION AND ORDER

ALESIA, District Judge.

Before the court is defendant’s motion for partial dismissal pursuant to Federal Rule of Civil Procedure 12(b)(6). For the following reasons, the court grants defendant’s motion for partial dismissal.

I. BACKGROUND

Plaintiff Children’s Surgical Foundation, Incorporated (“plaintiff’) has brought a breach of contract action against defendant National Data Corporation (“defendant”).
