MEMORANDUM AND ORDER

JOYNER, District Judge.

This case is once again before this Court for consideration and disposition of Otis Peterkin’s Petition for Writ of Habeas Corpus. For the reasons set forth below, the petition shall be granted.

History of the Case

The instant petition arises out of a series of events which began on November 29, 1981 with the robbery of the Sunoco Service Station located at Broad and Catherine Streets in South Philadelphia and the murder of two of its employees.
