One Alexander McClure, from whom both parties in this case claim title, owned a tract of land in Jefferson county. On February 1, 1878, he entered into a written agreement with plaintiff, Sarah Ellen Rudolph, wife of Alexander Wheeler Rudolph, to sell and convey to the wife thirty-seven and one half acres of the land in Henderson township for the consideration of $244, which was paid to McClure in instalments ; on June 12, 1880, a balance of $30.18 was paid and the purchase money indorsed on the agreement receipted in full.
