Rebelling against a shower bath administered to him by means of á hose in the hands of Harry Walters on the afternoon of September 6, 1913, in the town of Van *122Lear, Kentucky, the appellant brought this suit against Walters and the Consolidation Coal Company charging that the former at the time was the agent of the latter, and was performing duties within the scope of his employment, and that besides contracting a cold as a result of the operation, he was greatly humiliated, and'suffered mental pain and anguish, for which he sought to recover…
