PROCEDURAL BACKGROUND
The plaintiff in this case seeks judicial review of the final decision of the Commissioner of the Social Security Administration [“the Commissioner”] to deny his application for a period of disability insurance benefits. On May 19, 1997, Robert Glomski applied for federal disability insurance benefits under the Social Security Act, 42 U.S.C. § 405, alleging that he was disabled due to back pain related to degenerate disc disease.
