A valid contract, in writing, was entered into by the defendant on July 19th, 1920, with Herbert C. MeVoy, the husband of the complainant, to convey to him certain lands in Westfield, the deed to be delivered on October 1st, 1920. Prior to the latter date MeV>3r, with the consent of Baumann, assigned the contract to the complainant.
