HEMPHILL, District Judge.

This matter is before the court on the parties’ cross motions for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Plaintiffs, all police officers of Columbia, instituted this action under 28 U.S.C. § 1343(3), 28 U.S.C. § 2201 and 42 U.S.C. § 1983, alleging a deprivation of their constitutional right to due process and seeking a declaratory judgment that the administrative acts, customs and policies of the defendants, relative to the suspensions of the plaintiffs, violate the Fourteenth Amendment guarantee of due process.
