On the 28th day of October, 1876, the plaintiff commenced his suit in equity in the municipal court of Wheeling, against several pei'sons, whose names are stated in the bill. At the November rules, 1876, the plaintiff, filed his bill in the cause, which is as follows: “To the Honorable Gibson L. Cranmer, judge of the Municipal Court of Wheeling.
