This is a suit in equity for specific performance of an agreement to convey certain lands situated at Olaa in the island of Hawaii.
The defendant first moved to dismiss the cause on the ground that the subject matter of the suit was without the jurisdiction of a Circuit Judge of the First Circuit, because the land in question was situated in the Fourth Circuit.
