BOYLE, United States Magistrate Judge:
Before the court is the defendant’s motion for summary judgment, pursuant to Federal Rule of Civil Procedure 56. Plain tiff opposes the motion, asserting that there are issues of fact that necessitate a trial. For the following reasons, defendant’s motion is granted in part and denied in part.
