This is an appeal from a conviction, without intervention of a jury, of the appellant for the crime of Safe Burglary pursuant to Burns’ Indiana Statutes, Anno., (1956 Repl.), § 10-702(a).
At 2:25 A.M. on the morning of September 18, 1967, two (2) police officers were making their patrol of local business establishments in the city of Evansville, Indiana.
