This opinion, be it understood, must be read in connection with the opinion which was rendered by this court in the case of W. D. McCurdy v. Sallie B. Kenan, 178 Ala. 344, 59 South. 489.
*186So far as the questions involved in this case are concerned, we desire to say that it is admitted by all parties that the deed’ which was executed and delivered by John Dudley, Sr., to four of his children, viz., Joseph R.
