Appeal from a judgment of the Supreme Court (Breslin, J.), rendered November 1, 2012 in Albany County, upon a verdict convicting defendant of the crimes of rape in the first degree (two counts), rape in the third degree (two counts), attempted criminal sexual act in the first degree, attempted criminal sexual act in the third degree and endangering the welfare of a child.
