Arthur Kelly brought suit against the City Council of Augusta, on the following state of facts: He was employed on January 10, 1931, for a term of three years as canal foreman, at a salary of $150 per month. Under such employment he was an employee and not an officer of the city. He entered upon the performance of the terms of his contract, and faithfully performed his duties until October 1, 1931, when he was wrongfully discharged by the City Council of Augusta.
