I agree with the result reached by the majority. This concurring opinion is submitted because I feel that the majority opinion has not adequately set forth detailed facts pertaining to the case. In addition and throughout this case, the District has challenged the existence of a valid contract additional to its defense that the contract was unenforceable because it limited the District as to its governmental function.
