¶ 1. Farmers' Insurance Exchange appeals the portion of a judgment that awarded Laurie and George Briggs costs following confirmation of an arbitration award. According to this court's holding in Finkenbinder v. State Farm Mut. Auto. Ins. Co., 215 Wis. 2d 145, 572 N.W.2d 501 (Ct. App. 1997), costs are not available absent a litigated trial court proceeding. There was no such proceeding here, and therefore costs are not available.
