Appeal by the defendant, William F. Grell, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 7th day of February, 1902, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 5th day of February, 1902, denying the defendant’s motion for a new trial made upon the minutes.

Hatch, J.:
This action is brought against the sheriff of the county of New York for a wrongful conversion of certain goods. and chattels, claimed to be the property of the plaintiff, under a warrant of *147attachment issued against the property of Joseph Moravec, the husband of the plaintiff.
The property consisted of a small stock of goods contained in a delicatessen store, the business of which at the time of the conversion was carried on by the plaintiff.
