On June 28, 2001, plaintiff, Robert Potts ( “plaintiff’ or “Potts”), instituted this action against the City of Philadelphia, former Philadelphia Police Commissioner John Timoney, and numerous police officers, both known and unknown (collectively, “defendants”), asserting multiple claims under 42 U.S.C. § 1983 for violations of his rights under the Second, Fourth, Fifth and Fourteenth Anendments of the United States Constitution, and for various related state law claims.
