This is án application to this court, in the exercise of its original jurisdiction, for a writ of mandamus directed to the Hon. John B. Barnes, formerly judge of the seventh judicial district, requiring him to settle a bill of exceptions in a cause tried before the district court of Cuming county, of which he was judge.

It is alleged on the part of the relator, and not controverted by the respondent, that the cause was tried before the respondent-, sitting as the court, on the 4th day of December, 1883, the trial resulting adversely to the relator, who was the plaintiff in said cause, the…
