MEMORANDUM
McCLURE, District Judge.
BACKGROUND:
On August 15, 1997, plaintiff Francis X. Ryan commenced this employment discrimination action against Berwick Industries, Inc. (“Berwick”) and Henry T. Do-herty (“Doherty”) with the filing of a complaint pursuant to the Veterans Reemployment Rights Act (“VRRA”), 38 U.S.C. §§ 4301-4307.1 Plaintiff alleges that on August 15, 1991, defendant Do-herty, former Berwick CEO, terminated plaintiffs employment with Berwick because of his participation in the United States Marine Corps Reserves.
