Appeal from circuit court, Oneida county. Action by Anna Stedman against the city of Rome to recover damages for personal injuries. From a judgment dismissing the complaint with costs, and from an order denying a motion for a new trial made on the minutes, plaintiff appeals.

This action was to recover damages alleged to have been sustained by the plaintiff by reason of the negligence of the defendant. On the trial the plaintiff was nonsuited. The grounds of the motion were: (1) That the evidence did not establish the fact that the injury complained of was caused solely by the negligence of the defendant; (2) that the plaintiff did not show that she was free from contributory negligence; and (3) that the notice of the injury presented to the common council of the defendant was insufficient.
