This is an action of trespass on the case •for negligence brought in the Superior Court by the plaintiff, against the town treasurer of the town of Coventry, to recover damages for injuries sustained by the plaintiff through a defect in the Washington and Bowen’s Hill Road, a public highway in said town. The defect complained of is ■said to have consisted of a “hole, gully or washout,” running down a hill in said road for a distance of about sixty feet from, the gateway leading from the road into Bowen’s cemetery,, and to have been located between the ruts, in the path where; horses travel,…
