A now-deceased former inmate of the Missouri State Penitentiary, Jesse Lang, by his representative and mother, Ruth Lang, appeals the decision of the district court1 denying his motion to set aside judgment and order of dismissal and to compel discovery. We affirm.

Ms. Ruth Lang, representing her deceased son, Jesse, initiated this suit in October of 1975. She sought damages from several individuals, including Donald Wyrick, Warden of the Missouri State Penitentiary, alleging that the defendants had caused the death of her son through acts2 violative of the Civil Rights Act of 1871, 42 U.S.C.…
