An indictment was returned by a grand jury in the circuit court of Scott county, charging the plaintiff in error with having made an assault with a deadly weapon upon one Hubert Gregory. The circuit clerk certified said indictment to the county court of said county for trial, and upon a trial the plaintiff in error was convicted and a judgment was rendered upon the verdict of a jury and the cause is in this court upon a writ of error to said county court of Scott county.
