The plaintiff in this case operates a paper *50mill at the village of Plainwell, in Allegan county. The power for said mill is partly steam and partly water. The wafer power is obtained by means of a dam across the Kalamazoo river in the village of Plainwell. In the summer of 1902, the Plainwell Construction Company, Limited, built a dam across the Kalamazoo river below the plaintiff’s mill, and leased the same and the water power obtained therefrom to the Kalamazoo Valley Electric Company, the defendant and appellant.
