Appeal from a judgment of the County Court of Chemung County (Castellino, J.), rendered January 17, 1997, upon a verdict convicting defendant of the crime of assault in the first degree.

Defendant was indicted on one count of assault in the first degree. The indictment states that defendant, with intent to cause serious physical injury, stabbed Todd Mead three times in the chest and slashed Mead’s forearm.
