This is an appeal from a summary judgment rendered in favor of respondent (defendant below). The ground and reason for the summary judgment were that in a former action between the same parties on the same cause of action a final judgment had been rendered against the plaintiff and was a bar to the present action. The lower court said: “The dismissal in the prior case operated as an adjudication on the merits, NRCP Rule 41(b).” The former case was Zalk-Josephs Company, doing business as Triangle Steel & Supply Co. v.
