The defendant is neither the owner of the building nor the occupant of the space in which the alleged violations of the code relating to exit and fire escape signs occurred. It is the managing agent of the building. At all relevant times the space was under the exclusive occupancy and control of the Internal Eevenue Service of the United States. Neither lease with the United States has a forfeiture clause entitling the lessor to forfeit the lease for breach of covenant or for use of the premises in violation of a law or city ordinance or even for nonpayment of rent.
