Appellee filed his claim against appellant, before the Industrial Board of Indiana, under the *358Workmen’s Compensation Act, Acts 1915 p. 392, alleging that on August 7, 1916, he received personal injuries by reason of an accident arising out of and in the course of his employment by appellant in the city of Wabash, Indiana. On a hearing before the full Industrial Board, an award was adjudged in favor of appellee, from which appellant prosecutes this appeal.
