Appeal from a judgment of the County Court of Sullivan County (LaBuda, J.), rendered February 17, 2009, convicting defendant upon his plea of guilty of the crime of attempted murder in the second degree.

In April 2008, defendant shot his 16-year-old stepdaughter multiple times, striking her in the head and once in the hand that she had raised in an attempt to protect herself. As a result of the incident, defendant was charged by indictment with attempted murder in the second degree, criminal use of a firearm in the first degree, assault in the first degree and two counts of criminal possession…
