This suit was brought by appellant against appellee November 15, 1893, appellant alleging that for the years 1890 to 1892 he was the duly elected and qualified county attorney of Grayson County, Texas, and that said county was indebted to him in the sum of $1098.70 on account of costs and commissions against parties convicted in the justice and county courts in said county, said county having worked said convicts on county roads of said county, and having discharged said convicts.
