J. M. L. Sargent commenced this action in forcible entry and detainer against plaintiffs in error before a justice of the peace. The trial resulted in a judgment for the plaintiff, the defendants appealed to the county court, where a trial de novo resulted in a like judgment, from which an appeal has been prosecuted to this court.

It appears from the record that the defendant in error J. S. Shaver was the owner of the fee in the land involved herein, and that J. M. L. Sargent was the lessee thereof; that Sargent, after making demand for the premises and serving notice to…
