Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered July 12, 1977, convicting him of rape in the first degree and resisting arrest, upon a jury verdict, and imposing sentence. Judgment reversed, on the law and as a matter of discretion in the interest of justice, and a new trial ordered. On February 18, 1976 the complainant was allegedly raped at knifepoint in an elevator in the Copenhagen Building in Lefrak City. She claimed that she saw her attacker again in that vicinity in June, 1976. Then on January 5, 1977 she saw defendant in a Kansas Fried Chicken store…
