—Appeal by defendant from a judgment of the Supreme Court, Queens County (Linakis, J.), rendered June 23, 1983, convicting him of burglary in the second degree and criminal mischief in the fourth degree, upon a jury verdict, and sentencing him, as a persistent felony *971offender, to an indeterminate term of imprisonment of 15 years to life and to a determinate term of one year, with both sentences to run concurrently.

Judgment modified, as a matter of discretion in the interest of justice, by vacating the sentences. As so modified, judgment affirmed, and case remitted to the Supreme Court, Queens…
