WALTERS, Justice.

This is an action to recover damages for personal injuries sustained in the collision of two motor vehicles. The vehicles were traveling in the same direction on a state highway, and the collision occurred when one vehicle attempted to pass the other on the right-hand side. The appeal is from the district court’s determination that the plaintiff, Ron Ahles, was negligent per se based on a violation of I.C. § 49-633, which defines when passing on the right is permitted, and the district court’s subsequent apportionment of fault that denied the plaintiffs any recovery of…
