Plaintiff-appellant challenges an adverse ruling of the trial court rejecting his claim that the Colorado Guest Statute, C.R.S. 1963, 13-9-1, is unconstitutional. We affirm the ruling.

This wrongful death action arose out of an automobile accident in which appellant’s mother was killed while riding as a guest passenger in an automobile driven by defendant-appellee Diamond C. Hansen. Plaintiff filed a pretrial motion to strike defendant’s guest statute defense on the basis that the statute is unconsitutional in that it impermissibly discriminates between nonpaying guests and paying guests, and…
