*609Appeal from an order of the Supreme Court (Ferradino, J.), entered March 13, 1997 in Fulton County, which, inter alia, denied that part of defendants’ cross motion seeking to dismiss certain claims against defendant City of Johnstown.

This action arises out of a physical altercation in March 1994 which ensued between plaintiff and defendant Steven Lake, a police officer formerly employed by defendant City of Johnstown, when Lake stopped plaintiff’s vehicle during a routine traffic stop.
