Plaintiff-appellant Daniel Sugrue appeals from a judgment entered January 4, 1993 in the United States District Court for the Eastern District of New York, I. Leo Glas-ser, Judge, that dismissed Sugrue’s actions against the Department of Veterans Affairs1 for lack of subject matter jurisdiction pursuant to Fed.R.Civ.P. 12(b)(1), and against several named and unnamed employees of the VA (the ‘VA Employees”) for failure to state a claim upon which relief can be granted pursuant to Fed.R.Civ.P. 12(b)(6).
